韓国特許庁では以前から「包括名称」を理由とする商標の拒絶理由が多く、そのため2007年に新しい「包括名称」が多くの部分で幾つか導入されました。しかし、それでも外国の出願人からは不十分であるとの不満の声が特に多く上がっていました。
今回の審査基準の変更は、このような声に応えるためのもので、2009年の初頭に予定されていた施行を前倒ししてなされました。新しい審査基準は、2008年9月16日以降の出願に適用されることになります。
今回の変更審査基準の最も特徴的な点は、以前「1商品・1類似群」だけに対応されていた商品の指定が、複数の類似群をカバーする包括名称も多く採用された点です。
